Terms of Service

CrestWard ("we", "us", or "our") provides a Software-as-a-Service platform that helps medical clinics and doctors manage online reviews, generate AI-powered reply drafts, collect patient feedback, and track their online reputation.

Crestward is intended for licensed medical professionals and healthcare organisations. By using Crestward, you confirm that you are a registered medical practitioner or an authorised representative of a medical clinic.

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately at support@crestward.in if you suspect unauthorised access
• One account per clinic. Multiple doctor accounts within one clinic are supported under the Hospital plan

Crestward offers three subscription tiers:

• Solo: ₹1,499/month or ₹14,990/year — 1 doctor, 200 WhatsApp messages/month
• Clinic: ₹2,999/month or ₹29,990/year — up to 5 doctors, 1,000 WhatsApp messages/month
• Hospital: ₹6,999/month or ₹69,990/year — unlimited doctors, unlimited messages

Subscriptions renew automatically unless cancelled. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period — no pro-rata refunds are offered except as required by applicable law.

Pricing is subject to change with 30 days' notice to active subscribers.

You agree not to use Crestward to:

• Post fake, misleading, or fabricated reviews on Google Maps or any other platform
• Solicit reviews in exchange for payment, gifts, or preferential treatment
• Harass, threaten, or contact patients who have left negative reviews in bad faith
• Suppress or manipulate legitimate patient feedback through deceptive means
• Violate any applicable healthcare privacy regulation (MCI guidelines, PDPB, HIPAA where applicable)
• Use the platform for any purpose other than managing your own clinic's reputation
• Reverse-engineer, scrape, or attempt to extract data from the Crestward platform

Crestward's "Review Gating" feature (directing low-rated feedback privately to the clinic) is designed for service improvement, not to manipulate public review scores by blocking genuine patient experiences. Using it in bad faith violates these Terms and Google's review policies.

Crestward integrates with Google Business Profile API to sync and respond to reviews. By connecting your Google account:

• You confirm that you are the authorised manager of the connected Google Business Profile
• You authorise Crestward to read, respond to, and manage reviews on your behalf
• You agree to comply with Google's Terms of Service and review policies
• You acknowledge that posting replies via Crestward is equivalent to posting them yourself and you remain responsible for the content

Crestward uses AI (Google Gemini) to generate reply drafts. All AI-generated replies are presented for your review before posting. You are responsible for reviewing and approving any reply before it goes live on Google.

When patients submit feedback through your Crestward feedback link:

• You are the data controller for that patient feedback
• Crestward is a data processor acting on your instructions
• You are responsible for having a lawful basis to collect and process patient feedback
• You must not use patient contact information (WhatsApp numbers) to harass, spam, or contact patients for purposes other than feedback collection

Crestward uses artificial intelligence to generate review reply drafts. You acknowledge that:

• AI-generated drafts are suggestions only and must be reviewed by a human before posting
• You are fully responsible for any reply posted to Google, regardless of whether it was AI-assisted
• Crestward's AI is designed to follow HIPAA guidelines but cannot guarantee compliance in every case — always review replies before posting
• Crestward is not liable for any professional, legal, or reputational consequences of replies you choose to post

Crestward and all associated software, designs, trademarks, and content are owned by Crestward Technologies Pvt Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the platform for the duration of your subscription.

Your clinic data, patient feedback, and reviews remain your property. Crestward does not claim ownership over any content you create or that your patients submit.

Crestward targets 99.5% monthly uptime. Planned maintenance will be communicated in advance. We are not liable for downtime caused by third-party services (Google APIs, Supabase, WhatsApp) or events beyond our control.

To the maximum extent permitted by Indian law, Crestward's total liability to you for any claim arising from these Terms or your use of the service shall not exceed the subscription fees paid by you in the 3 months preceding the claim.

Crestward is not liable for: loss of reviews, changes to Google's review policies, damage to your online reputation, loss of business arising from negative reviews, or any indirect or consequential losses.

Either party may terminate the subscription at any time. Crestward may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or use the platform to manipulate reviews.

Upon termination, you may export your data within 30 days. After 90 days, all data is permanently deleted.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala, India.

We will notify active subscribers by email at least 14 days before material changes to these Terms. Continued use after the effective date constitutes acceptance.
